II. How We Collect and Use Your Personal Information

We follow the principles of lawfulness, legitimacy, necessity, and good faith, and collect and use your personal information only for the purposes described below. In accordance with the Provisions on the Scope of Necessary Personal Information for Common Types of Mobile Internet Applications, MemoMind is a "utility tool" category App. Each function is described below; the general rules are:

Please note: if the personal information you provide is not your own (including other persons' voices contained in your recordings), please ensure that you have obtained the consent of the relevant subjects.

1. Account Registration/Login

(1) We collect your mobile phone number or email address and verify your identity through a verification code; you can use the other services only after registering and logging in. You may also log in using authorization from a third-party account (such as a Google account), in which case we will collect the account identifier, email address, nickname, and avatar returned by that platform after your authorization.

(2) Your account and password are stored in encrypted form on our servers. Please keep them safe to guard against misappropriation.

2. Connecting to and Managing Hardware Devices

(1) We collect connection log data and device information (device serial number, MAC address, firmware version, and battery status) in order to pair and maintain the connection, push firmware updates, and troubleshoot problems.

(2) After pairing, we conduct real-time data transmission via Bluetooth only while you are using this software (including voice information recorded through the hardware device); after you enable cloud space, the data is stored in the cloud so that you can access, edit, and replay it and download backup data.

(3) WiFi Quick Transfer (AI MemoCard): after the device enables a hotspot, this software connects directly to the device via the local network to transfer recording files, without passing through the public Internet.

(4) Permissions: Bluetooth, nearby devices, storage, and local network/WiFi-related permissions; for their purposes, see Item 17. The location permission is a mandatory requirement for scanning Bluetooth devices on Android 12 and earlier system versions.

3. Recording

(1) When you record (including call recording, audio/video recording, and on-site recording), we collect your voice information and/or other recording content. Recordings are stored only on the device side (the hardware device or your phone locally); only after you enable cloud space will they be stored in the cloud.

(2) Permissions: microphone and storage.

4. Speech-to-Text and Content Organization

(1) We collect your voice information and/or other recording content, transcribe it into text on cloud servers, and save the transcription text for you to view; on this basis, we generate AI-generated content such as summaries, titles, tags, to-do items, and translations.

(2) Labeling of AI-generated and synthesized content: You acknowledge and agree that, in accordance with laws and regulations, we add explicit labels to AI-generated content (including summaries, titles, tags, to-do items, and AI assistant replies), displaying the notice "Content generated by AI, for reference only." Verbatim transcription is a transcript of speech, does not constitute generated or synthesized content, and is not labeled as such.

5. Intelligent Q&A and Retrieval

(1) When you use the AI assistant or the retrieval function, we collect the questions you enter and the context needed to answer them (such as the transcription text and summaries of the corresponding recordings, and relevant long-term memories) in order to return results to you.

(2) Replies generated by artificial intelligence may contain errors or inaccuracies, are for reference only, and do not constitute any professional advice.

(3) Voice conversations and images: Real-time voice in voice conversations and the images you send are processed by artificial intelligence service providers; conversations are converted into text, saved in your conversation history together with the images, and may be distilled into long-term memories. We do not store the audio of voice conversations.

6. Voice Search and Voice Input (Optional)

(1) In the search box, the AI assistant dialog box, and similar places, you may use your voice instead of typing; we invoke the speech recognition capability of the operating system to convert it into text.

(2) Please note in particular: this function is provided by the operating system vendor (Apple / Google); what you say will be processed according to its rules and may be transmitted to its servers. Such processing is subject to their respective privacy policies and is not governed by this Policy.

(3) This function requires the microphone permission; on iOS, the speech recognition permission is also required. If you do not use it, you may simply type.

7. Speaker Labeling and Voice Features (Optional)

(1) Information collected:

⚠ Voice feature information constitutes biometric information and is sensitive personal information.

(2) Tiered processing of your own voiceprint and others' voiceprints:

Storage LocationPrerequisite
Your own voice features ("My Voice" sample)Stored on our servers with your consent, to recognize your own speech across your devices; with your consent, we also automatically extract your own voice features from your recordings to improve recognition accuracyRequires your separate consent; automatically extracted voice samples can be viewed or deleted at any time; turning off automatic speaker labeling stops extraction and deletes them
Voice features of other people in recordingsSynchronized to our servers after you turn on automatic speaker labelingRequires your separate consent when turning it on (off by default); please ensure you have that person's consent

The reason: your own voice features are authorized by you personally; for other persons in your recordings, we are unable to directly notify them or obtain their consent, so you must turn on the function yourself and are responsible for obtaining their consent.

After you turn off automatic speaker labeling, we will no longer save or synchronize other persons' voice features on the server side; the data already synchronized to the server will be deleted and retained only on your local device.

For the above processing involving voice feature information, we will separately obtain your consent, by means such as a pop-up window, before you use the corresponding function for the first time.

(3) Please understand and note in particular:

a. Voice feature information is technically processed feature data, used to distinguish between different speakers within the scope of your recordings. We follow the principle of minimum necessity and use it only within that scope; we do not use it for identity authentication or for any purpose other than speaker distinction.

b. If you do not wish to save any voice feature information, you may turn off automatic speaker labeling. After it is turned off, the system will no longer automatically distinguish speakers based on voice features, but this will not affect transcription, summaries, or other functions.

(4) Your control: you may turn off or re-enable automatic speaker labeling at any time, and view saved speaker names and voice features, and rename them, delete them individually, or delete them in batches; after deletion, the corresponding data on the server side will be cleared simultaneously.

(5) Permissions: recording a "My Voice" sample requires the microphone permission. If you decline, you will be unable to add a voice sample, but this will not affect the other functions of automatic speaker labeling.

8. Emotion and Cognition Analysis

(1) Emotion and cognition analysis is a core function of this product. We perform analysis based on the acoustic features of your speech and the transcription text, and generate emotion labels (emotion category and intensity of recording segments), cognitive dimension indicators (calculated based on language and communication features), periodic reports (weekly aggregations of results and trends), and topic profiles (performance overviews organized by life/work domain).

⚠ The above analysis results constitute inferential information about your personal characteristics, and we apply strict access controls and protection measures to them.

⚠ The analysis is performed only on segments of your own speech. We do not perform emotion or cognition analysis on the speech of other persons in your recordings.

(2) Please understand in particular:

a. The analysis is performed by models we deploy on our own servers and is not provided to third-party artificial intelligence service providers.

b. The analysis results are statistical inferences based on speech and text features; they are not medical or psychological diagnoses, have no diagnostic effect, and should not be relied on as the basis for any health or medical judgment. If you have health concerns, please consult a qualified physician.

c. We will not, on the basis of the analysis results, subject you to differentiated pricing, restriction of services, or other adverse treatment.

d. To delete analysis results that have already been generated, you may contact us through the methods in Chapter X, and we will process your request after verifying your identity.

9. Recording Location Tagging (Optional)

After you enable this function, we record city-level location information at the time of recording so that you can look up recordings by location. This function requires the location permission; declining or turning it off will not affect recording or other functions.

10. Sharing (Optional)

(1) You may share content such as recordings, transcription text, or summaries outside of this software through the system share panel; the recipient and processing method are determined by the target application you select. The content you share may contain other persons' voices or related information; please assess this carefully before sharing.

(2) Sharing a conversation link: when you choose to share a conversation link, we store a text copy of that conversation and create a link; anyone with the link can view that conversation without logging in. You can remove the share at any time; removing the share, deleting the original conversation or cancelling your account disables the link immediately, but we cannot retrieve content others have already copied or forwarded.

11. Firmware Staged Rollout

In order to allow some users to experience new hardware functions first, we will send new firmware versions to certain users in a targeted manner, and therefore need to obtain your device serial number and the device information permission.

12. Third-Party Platform Integration (MCP and Open Platform) (Optional)

(1) You may authorize third-party artificial intelligence assistant products (such as ChatGPT, Claude, etc.) to access your data in this software via the MCP protocol. Within the scope you authorize, such platform may: read your recording titles, recording time and duration, content summaries, transcription text (including segmentation and speaker identifiers), topic tags and temporary download links to recording audio; read, save, modify or delete the long-term memories it saves for you; read your skills; and use the third-party apps you have connected to perform actions. You may also authorize open platform partners vetted by us to obtain the above data (certain partners may obtain temporary download links to recording audio).

(2) Please note in particular:

a. This service may be enabled only upon your express authorization. Without your separate authorization, we will not provide your data to any third-party platform.

b. Third-party platforms cannot modify or delete your recordings, transcripts or summaries. When a third-party platform uses an app you have connected to send, create or otherwise act, the action is performed only after you confirm it on your phone; deletion is not supported.

c. Your recordings may contain the voices and speech of other persons, and once you authorize, such information will also be provided to the third-party platform. Please assess carefully before authorizing, and exercise particular caution where sensitive meetings are involved.

d. After obtaining data, the third-party platform may further process it within its own systems (including display, caching, and use in the operation of its models). Such processing is subject to its own privacy policy, for which it bears independent responsibility, and which is beyond our control.

e. For how to revoke authorization, see Item (3) of Point 2 of Chapter VI; after revocation, we will immediately cease providing data to that platform.

13. Subscription and Payment

When you purchase a subscription, we collect order identifiers, subscription status, transaction amount, and transaction status, in order to complete purchases, renewals, refunds, and reconciliation. Payment is completed by the app store or a third-party payment institution; we do not collect or store your payment account information such as bank card numbers. For the relevant third parties, see the MemoMind Third-Party Information Sharing and SDK List.

14. Contacting Customer Service

When you contact customer service, we may need you to provide contact information such as a mobile phone number or email address, as well as necessary information relating to your request, and we may collect records of your communications (in the form of text, images, audio/video, or calls), in order to verify your identity and resolve your issue.

15. Message Notifications

We send you notifications such as recording processing progress, system announcements, and product updates via in-app messages. You may turn off this product's notification permission in your device's system settings.

16. Operational Statistics and Product Optimization

We automatically collect usage logs for the purposes of compiling usage statistics, troubleshooting issues, ensuring service stability, and optimizing the experience, including: App version number, operating system version, network status, IP address, and request time; page visit records, function usage records, and operation times; and error and crash logs.

17. Permission List

Enabling a permission means you authorize us to collect and use the relevant information to provide the corresponding service; disabling it withdraws that authorization, after which we will no longer collect information based on that permission and will be unable to provide the corresponding service, but this will not affect processing previously carried out.

18. Notes on Personal Information Processing

(1) In accordance with applicable laws and regulations, we will technically process your personal information so that it cannot precisely identify you as an individual, and then use it for academic research or statistical analysis on an anonymized or de-identified basis, in order to improve our products and services. We will not use your voice information, transcripts or any other content to train any model or algorithm.

(2) In accordance with laws and regulations, your consent is not required for the processing of your personal information in the following circumstances: where necessary for the conclusion or performance of a contract to which you are a party, or for the implementation of human resources management in accordance with the law; where necessary for the performance of statutory duties or statutory obligations; where necessary to respond to a public health emergency, or, in an emergency, to protect the life, health, and property safety of a natural person; where personal information is processed within a reasonable scope for the purpose of news reporting or public opinion supervision in the public interest; where personal information that has been lawfully disclosed is processed within a reasonable scope; and other circumstances prescribed by laws and administrative regulations.

(3) Self-start notes: to ensure that this application can normally receive push messages when it is closed or running in the background, this application must use the self-start capability, and there will be, at a certain frequency, self-start or associated-start behavior of this application being awakened via broadcasts sent by the system, which is necessary for the realization of functions. When you open a content-type push message, the relevant content will be opened only after your express consent; without your consent, there will be no self-start or associated start.

19. Family Sharing (Optional)

(1) You may create a family space, or join one with an invite code, to share shopping lists, chores, plans and reminders with your family. The name you use in the family and the items you add are visible to all members of that family; your recordings, transcripts, personal memories, emotion analysis results and personal to-dos are not shared.

(2) You may leave a family space at any time; the items you added remain after you leave. If you cancel your account, we will remove you from the family space and change the name shown on your items to "Former member".

20. Long-Term Memory (Optional)

(1) Auto memory is on by default. When it is on, we extract key points about you and others from your recordings and conversations with the AI assistant, and record actions you complete as one-sentence summaries (without full content such as email bodies), for the AI assistant to refer to when answering. Locations, emotion and cognition analysis results, and voiceprints are never remembered; long-term memory is not shared with family members or used to train models.

(2) You can simply ask the AI assistant to show, forget or correct what it remembers, or to stop remembering (e.g. "stop remembering things about me"); once stopped, it no longer learns new things or uses what it remembers. Long-term memories extracted from a recording or conversation are kept after you delete it; to delete them, ask the AI assistant or contact us through the methods in Chapter X.

(3) Long-term memory may contain information about others in your recordings; please obtain their consent in advance.

(4) We extract request types from your requests to the AI assistant to personalize skill recommendations, without viewing the original content. Turning off long-term memory pauses this, and you can also ask the assistant to delete this information.

III. How We Entrust the Processing of, Share, Transfer, and Publicly Disclose Your Personal Information

1. Entrusted Processing

We will entrust third parties (including companies, organizations, and individuals) to process certain of your personal information, and will sign strict data processing agreements with them, clearly stipulating the purpose, duration, and method of processing, the categories of personal information, the protection measures, and the rights and obligations of both parties; we will supervise them to process personal information only in accordance with our instructions, this Policy, and the relevant confidentiality and security measures, and not beyond the agreed purposes and methods. If you refuse to allow an entrusted party to collect the information necessary for providing its services, you will be unable to enjoy the services provided by that third party.

The third parties actually entrusted by this product to process your personal information, the scope of sharing, and the third-party SDKs and system interfaces integrated in the App are detailed in the MemoMind Third-Party Information Sharing and SDK List. That list is an integral part of this Policy and will be updated as functions change; before adding a new third party or expanding the scope of sharing, we will first update the list and obtain your consent in accordance with the law.

2. Sharing

We will share only necessary information within the scope of the purposes stated in this Policy, and will require our affiliated companies to adopt protection measures no less stringent than those stated in this Policy; if an affiliated company changes the purposes of processing, it will be required to seek your consent again.

(4) Sharing with authorized partners: certain services are provided jointly by us and authorized partners. We will share only the necessary personal information for lawful, legitimate, necessary, specific, and explicit purposes, and our partners have no right to use it for any other purpose.

(5) When you use Family Sharing: the items you add to a family space and the name you use in the family will be visible to the other members of that family (see Item 19 of Chapter II). Such sharing is initiated by you, and you may leave at any time.

We will sign strict confidentiality agreements with the parties with whom we share personal information, requiring them to process personal information in accordance with our instructions and this Policy, and not beyond the agreed purposes and methods.

3. Transfer

We will not transfer your personal information to any third party, except in the following circumstances: (1) with your explicit consent; (2) where necessary as required by applicable laws and regulations, legal procedures, or mandatory administrative or judicial requirements; (3) in the event of a merger, acquisition, bankruptcy liquidation, or similar circumstance involving the provider of this product's services that involves a transfer of personal information, we will inform you of the name and contact information of the recipient, and will require the recipient to continue to be bound by this Policy; if the recipient changes the original purposes or methods of processing, it must seek your consent anew.

In accordance with the law, providing anonymized information externally does not constitute the entrusted processing, sharing, transfer, or public disclosure of personal information, and does not require separate notice to you or your consent.

IV. How We Protect Your Personal Information

  1. Except as prescribed by laws and regulations or as otherwise agreed in this Policy, we will not disclose or reveal your personal information to third parties without your permission.
  1. You understand and agree that, on the premise of not disclosing any individual user's private data, we have the right to conduct technical analysis of the entire user database, and only data that has been analyzed, organized, and anonymized will be used commercially.
  1. Data Security Measures

(1) We have adopted security measures consistent with industry standards to prevent your personal information from unauthorized access, use, or modification, and to avoid data damage or loss, including: HTTPS, TLS/SSL encrypted transmission and encrypted storage; anonymization or de-identification processing and isolation; data classification and grading as well as data security management and development norms; and, through confidentiality agreements and strict access control and monitoring, permitting access only by those employees and partners of ours and our affiliates who have a genuine need to know.

(2) For sensitive personal information such as your voice information and voice feature information, as well as emotion and cognition analysis results, we have established stricter internal access controls, limiting access to personnel for whom it is genuinely necessary for the performance of their duties.

(3) We will take all reasonably practicable measures to ensure that no irrelevant personal information is collected. For retention periods, see Chapter V.

(4) The Internet is not absolutely secure, and communications such as email and instant messaging are not encrypted; please do not send personal information through such means, and please use complex passwords to keep your account secure.

(5) In the event of a personal information security incident, we will, in accordance with the law, promptly inform you by email, SMS, telephone, notifications, or other means of the cause of the incident, the harm it may cause, the categories of information involved, the measures we have taken or will take, and suggestions on precautions you may take; where it is difficult to inform each person individually, we will issue an announcement, and we will proactively report the handling of the incident as required by regulatory authorities.

V. How We Store Your Personal Information

1. Location of Information Storage

We will store and process your personal information in accordance with the laws and regulations of your country or region, and adopt protection measures that comply with local data security requirements. Your personal information may be processed and stored in the country or region where we or our service providers are located, which may be different from where you are located. For protection measures, see Chapter VIII.

In the following circumstances, we may lawfully process or transfer your personal information: where laws and regulations expressly so provide; where your explicit authorization has been obtained; where you engage in proactive individual conduct such as cross-border transactions via the Internet.

2. Duration of Information Storage

We will retain your personal information during your use of this service for the time necessary to achieve the purposes stated in this Policy, unless otherwise provided by laws, regulations, or national normative documents; after the retention period expires, we will delete or anonymize it. The retention rules for each type of information are as follows:

After you cease using MemoMind, we will stop collecting and using your information, except as otherwise provided by laws, regulations, or regulatory authorities. If the service ceases operation, we will inform you by notices and announcements, and will delete your personal information retained on our servers within the statutory period.
